He credited forming an LLC with still being in business after going through a business related lawsuit. I hear these stories all the time and it’s easy to forget that I should pass them on so you can learn from the mistakes others make as well as how their correct decisions helped them.

 If forming an LLC could save his business, could it do the same thing for you? Are you currently a sole proprietor? In speaking with this customer, I was reminded of just how important it is to layer protection. We are constantly asked about the requirements for LLC formation. At times, I think it seems that we are being too vague when we talk to our customers about this topic. The truth is that there are so many rules, so many requirements, and just too much that is different between states to answer some of our customer’s questions without sending them one of our training manuals specific to their state. That’s right…not only do we have LLC formation training manuals, we have manuals specific to each state. The rules vary so greatly that it can be overwhelming to attempt an explanation in just one phone call. 

So, how do we solve that? 

Obviously, different customers want different levels of information and understanding. To help provide at least a general understanding we wrote an article that can be found on our site. What Online Incorporation Services Don’t Want You To Know

I suppose every industry has trade secrets and no doubt they each guard them very carefully. Often, these secrets deal with the truth about products and services they are trying to sell you. Wouldn’t it be nice if the companies you deal with would be honest about whether you need their service or not? When was the last time you spoke with a sales person who said, “You know, I would love to sell you product X, but here’s a way you can do it cheaper by yourself”? That’s exactly what I’m about to do.

Here is the truth…You don’t need to use an incorporation service to help you with an LLC formation or with incorporating a business!!

I have worked for online incorporation services for some time. In fact, I am in the sales side of the business and I help people when they want to form an LLC or assist them with their business incorporations every day. So why would I jeopardize my job to blow the whistle on a secret that the whole industry guards so closely? The truth is, I wouldn’t. I have a family to feed and bills to pay just like everyone else, but I have been very fortunate to find an opportunity with a company that doesn’t just let me tell you this…they encourage it! We are taught to always do what is best for the customer, even if that means we talk ourselves out of a sale. Does that mean we don’t help customers with their business formations? Absolutely not. Instead, we focus on customers who can benefit from the expertise we have to make the process easier or better for them.

Here is what I mean. Some customers who come to us have formed several companies and are familiar with the Articles of Organization, Operating Agreements, Federal Tax ID’s, etc. They think we can provide some additional magic touch they cannot provide if they do the paperwork themselves. This type of person may not be the customer we are looking for and we help them understand their options so they will be happy with the outcome. On the other hand, we regularly speak with customers who have never been through an LLC formation or they have never tried incorporating a business and don’t know how to write an Operating Agreement. Guess what? An online incorporation service like ours may be just what they need. For this customer, we can take out the guess work and make the whole process more comfortable and more accurate, with fewer chances for mistakes. We also work well with customers who want to spend their time focused on other aspects of starting their company. The point is, you should know your options. Speak to people you trust about what might be best for you in your specific case. An online incorporation service might be perfect for you, but you just might be better off on your own.
